RULES OF THE PROMOTIONAL OPERATION
"Your opinion could win you €100"
Article 1 – Organizer
The promotional operation "Your opinion could win you €100" is organized by Joël Christian Voisin, an individual entrepreneur operating under the trade name Temeo Company, registered with the Paris Trade and Companies Register under number 989 844 527 R.C.S. Paris, whose main establishment is located at 60 rue François 1er, 75008 Paris, operating the merchant site Confort Enceinte.
Hereinafter referred to as "the Organizer".
Article 2 – Principle of the operation
Customers who have purchased one or more products on Confort Enceinte can share their experience by leaving a review on the product concerned.
Each eligible review entitles the participant to one entry in the monthly prize draw, offering a chance to win a Confort Enceinte gift voucher worth €100.
Participation is completely independent of the rating and content of the review.
A positive, neutral, or negative review has exactly the same chances of winning.
Article 3 – Eligible persons
Participation is open to adult individuals who have placed an order on Confort Enceinte.
The Organizer, persons directly involved in the organization or the draw, as well as members of their household, are excluded from the operation.
Article 4 – Conditions for review eligibility
To be eligible for participation:
- the product reviewed must have been effectively ordered on Confort Enceinte by the participant;
- the review must concern this product and correspond to a real experience;
- the Organizer must be able to link the review to the order including the product concerned;
- the review must have been posted during the monthly period concerned.
Reviews can be posted directly on the Confort Enceinte website via Judge.me or following a review request sent by Judge.me.
The channel used to post the review has no bearing on eligibility, provided that the purchase of the product concerned can be verified.
A simple "verified buyer" status does not exempt the Organizer from verifying, when necessary, that the product reviewed effectively corresponds to a product purchased by the participant.
Article 5 – Number of entries
The rule is:
1 product purchased + 1 authentic review of this product = 1 entry.
Thus, a customer who has purchased three different products and leaves an eligible review for each of them obtains three entries.
The same purchase of the same product cannot generate multiple entries by publishing several reviews.
The purchase of several identical units of the same product within the same order only entitles to one entry for the review concerning this product.
Article 6 – Freedom of review
No minimum rating is required.
Participation cannot be refused or favored due to the number of stars awarded or the positive, neutral, or negative nature of the comment.
The Organizer cannot modify the result of the draw based on the content of a review.
Fictitious, fraudulent, duplicated reviews, reviews unrelated to the product, or reviews not based on a real experience may be declared ineligible.
Article 7 – Participation period
Each period corresponds to one calendar month, from the 1st day of the month at 00:00 to the last day of the month at 23:59, Paris time.
The review participates in the draw corresponding to the month in which it was posted.
The draw is held within seven days following the end of the month concerned.
Article 8 – Creation of the draw list
After the close of the month, the Organizer establishes the final list of eligible reviews.
For each review, the Organizer may verify the necessary information in Judge.me and in the Confort Enceinte order data to confirm that the participant has effectively ordered the product concerned.
Each eligible entry then receives a unique number, between 1 and the total number of entries for the month.
The list is finalized before the draw and kept to justify its process.
Article 9 – Draw procedure
The winner is designated by means of a computerized random number generator.
The procedure is as follows:
- the final list of entries is established;
- a unique number is assigned to each entry;
- the generator is parameterized between number 1 and the total number of entries;
- a number is randomly generated;
- the participant corresponding to the generated number is designated as the winner.
Each entry has exactly the same chance of being drawn.
No manual selection of the winner is made.
The Organizer retains the list used for the draw as well as a record of the result.
If the selected entry is subsequently recognized as ineligible or fraudulent, a new draw is conducted among the remaining eligible entries.
Article 10 – Absence of participants
If no eligible entry is recorded during a month, no draw is carried out for that period.
The prize is not automatically carried over to the following month.
Article 11 – Prize
One winner is designated each month that has at least one eligible entry.
The prize consists of:
1 Confort Enceinte gift voucher worth €100 including VAT.
The voucher is valid for six months from its issue date and can be used on Confort Enceinte.
It cannot be exchanged for cash or reimbursed in cash.
The technical terms of use for the voucher, particularly regarding any remaining balance after initial use, are those indicated when it is handed over to the winner.
Article 12 – Canceled orders, fraud and right of withdrawal
An entry corresponding to a fraudulent or canceled order before the customer could have a real experience of the product may be declared ineligible.
The operation in no way limits the consumer's legal rights, including their right of withdrawal and legal guarantees.
The legitimate exercise of a consumer right cannot lead to a sanction unrelated to the objective eligibility conditions provided for in these rules.
Article 13 – Winner notification
The winner is contacted at the email address used to link their entry to their order.
They have 14 days after the message is sent to respond.
In the absence of a response within this period, the Organizer may proceed with a new draw among the other eligible entries.
Article 14 – Transparency regarding reviews
Posting an eligible review provides a chance to win a €100 gift voucher.
This potential compensation is clearly brought to the attention of consumers.
It rewards the submission of an authentic review and not its positive nature.
A one-star review therefore has exactly the same chance of winning as a five-star review.
This transparency is important: regulations on reviews specifically require informing of the existence of compensation provided in exchange for submitting a review.
Article 15 – Personal Data
The necessary data are used only to the extent necessary for verifying eligibility, organizing the draw, designating and contacting the winner, and justifying the proper conduct of the operation.
They are processed in accordance with Confort Enceinte's privacy policy and applicable personal data protection regulations.
Data specific to the draw should not be kept indefinitely; their retention period must be proportionate to the purpose pursued. This is the principle reiterated by the CNIL.
Article 16 – Fraud
Any attempt to artificially obtain additional entries may result in the exclusion of the entries concerned.
This particularly concerns fake reviews, identity theft, multiple reviews artificially related to the same purchase, or any manipulation intended to unduly increase the chances of winning.
Any exclusion must be based on an objective criterion and never on the unfavorable nature of the review.
Article 17 – Modification or termination of the operation
The Organizer may modify, suspend, or terminate the operation for a legitimate reason.
However, a modification cannot be used to retroactively alter the conditions of a draw already closed to the detriment of participants.
Any substantial modification applicable to future periods will be brought to the attention of consumers.
Article 18 – Complaints
Any question or complaint concerning the operation can be addressed to Confort Enceinte via the contact methods available on the website.
A dispute concerning the eligibility of an entry or the draw will be examined in light of these rules and the elements allowing the course of the operation to be traced.
Article 19 – Acceptance and availability of the rules
Participation in the operation implies acceptance of these rules.
The rules can be consulted free of charge on Confort Enceinte throughout the duration of the operation.
